Abstract [en]
The report first provides general background and deals with questions of legal base and harmonisation approach (Section 2). It then analyses in more detail the structure of the Directive and the main substantive provisions, including an overview of the black list of prohibited practices (Section 3). In Section 4 the report sheds some light on the tricky issue of defining the scope of the Directive, while Section 5 sets out to disentangle the complex relationship of the UCPD to other Community instruments in the field. Section 6 is devoted to the impact of the UCPD on private international law and its relation to the Draft Rome II Regulation. Section 7 gives a brief overview of enforcement and procedural questions. Finally, Section 8 tries to gauge into the prospective challenges of transposition and uniform implementation.
