Internationell rätt och nationella regleringar av tillträde och rättigheter till genetiska resurser har utvecklats snabbt under det senaste decenniet. Utvecklingen har lett till en allt intensivare diskussion om äganderätt och behovet av reglering av genetiska resurser. Nordiska ministerrådets (fiskeri-, jord- och skogsbruks- och livsmedelsministrarna jämte miljöministrarna) deklaration om tillträde och rättigheter till genetiska resurser är ett viktigt ställningstagande rörande den rättsliga statusen av det gemensamma nordiska materialet i Nordiska genbanken. Deklarationen omfattar även beslut om rättigheter och tillträde till genetiska resurser från domesticerade växter och dessa vilda släktingar, husdjur, skogsträd samt pekar på behovet att klargöra den legala statusen för vilda genetiska resurser. Ministrarna rekommenderar att de nordiska länderna stärker tillämpningen av internationella avtal på genresursområdet. In the past few decades, there have been rapid developments in the field of international law and national regulations governing the access and rights to genetic resources. The developments have led to an intensification of the debate on property rights and the need for regulating access to genetic resources. The Nordic Council of Ministers’ (Ministers for agriculture, forestry, fisheries and food and Ministers of the environment) declaration on access and rights to genetic resources represents an important standpoint concerning the legal status of the accessions of the Nordic Gene Bank. The Declaration also addresses rights and access to genetic resources from domesticated plants, farm animals, forest trees and wild genetic resources. The Ministers conclude by recommending that the Nordic countries facilitate the implementation of international agreements in the field of genetic resources.
