    Hat och hot på nätet: en kartläggning av den rättsliga regleringen i Norden från ett jämställdhetsperspektiv2017Report (Other academic)
    Abstract [sv]

    Hur näthat ska stoppas är en aktuell fråga i alla nordiska länder. Men att komma åt förövarna är inte helt enkelt. Ett av problemen är att lagstiftningen på området inte är uppdaterad. Därför har Nordisk information för kunskap om kön (NIKK), på uppdrag av Nordiska ministerrådet, kartlagt den rättsliga regleringen av hat och hot på nätet.

    Rapporten visar att såväl kvinnor som män är utsatta för kränkningar på nätet – i ungefär lika stor utsträckning. Män och kvinnor drabbas dock på olika sätt. När män – särskilt i offentligheten – utsätts för näthat är det oftare fråga om kränkningar med anspelning på yrkesskicklighet och kompetens eller hot om våld. Kvinnor utsätts istället för kränkningar med betydligt större inslag av sexism, sexuella hot och trakasserier som snarare kopplar an till person än profession.

    I hela Norden råder det en osäkerhet kring hur bestämmelserna som omfattar hatbrott ska tillämpas och var gränsen mot yttrandefriheten går, vilket leder till att bestämmelserna inte används i den utsträckning som i teorin är möjligt. Det innebär att det praktiska skyddet är litet för samtliga grupper, och i dagsläget obefintligt för dem som utsätts på grund av kön. Det bör sättas i relation till den forskning som visar att näthat mot kvinnor i stor utsträckning kan kopplas till kön.

    Arne Fliflet har fulgt op på ”Strategi og handlingsplan for nordisk mobilitet 2014-2017” og udredt de juridiske forudsætninger og behovet for et nordisk grænsehindringsombud. Spørgsmålet har tidligere været udredt. Det blev ikke bedømt som farbart, at oprette egentlige nye strukturer. Det har resulteret i et ønske om at få udarbejdet en betænkning, der beskriver behovet for et styrket samarbejde mellem Ombudsmandsinstitutionerne og de juridiske forudsætninger.

    Betænkningen gennemgår: mandat for opgaven, definitioner på grænsehindringer, betydningen af Helsingforsaftalen, arbejdet med grænsehindringer, mulighederne for at inddrage ombudsmandsinstitutionerne i arbejdet, det retlige grundlag for institutionernes arbejde, ombudsmændenes opgaver, særtræk ved forvaltnings- og domstolsordningen i de nordiske lande, de karakteristiske træk ved grænsehindringer og budgetmæssige konsekvenser.

    Abstract [sv]

    Administrativa avgiftspåföljder av straffkaraktär har under de senaste åren stått föremål för ett växande intresse och debatt i de nordiska länderna. Förevarande forskning kartlägger rättsläget gällande sanktionsavgifter i Finland samt Sverige, Norge och Danmark. I forskningen undersöks hur garantier för god förvaltning och rättvis rättegång kan säkerställas i förfaranden som gäller påförande av sanktionsavgift, samt överklagandet av dessa ärenden. I studien jämförs och analyseras dessa europarättsliga krav med de nationellrättsliga, nordiska undersökningar som utförts. Dessutom diskuteras principiella utgångspunkter som ska beaktas vid reglering av sanktionsavgifter. Forskningen har utförts av professor Leena Halila och doktorand Veronica Lankinen vid Juridiska fakulteten, Helsingfors universitet, samt universitetslektor Annika K. Nilsson, vid Juridiska fakulteten, Uppsala universitet.

    The future of Nordic labour law: Facing the challenges of changing labour relations2020Book (Other academic)
    Abstract [en]

    Is labour law in the Nordic countries prepared to meet future challenges, or is there a need for adjustments and renewal? These questions form the backdrop for the analysis in this report. The Nordic systems of labour law are built on a binary divide between employees and the self-employed. As a main rule, employees are protected by labour law, while self-employed are not, and the employer is responsible for complying with the legal framework. If future labour relations make it harder to assess whether a worker is an employee or self-employed, and to decide who is the employer, this might undermine the efficiency of labour law regulations. The report analyzes the adaptability of the legal framework, and points at strengths and weaknesses. Furthermore, the study discusses how the identified challenges can be addressed, by suggesting avenues for legal development and reform. The report is the concluding analysis of Pillar VI in the project Future of Work: Opportunities and Challenges for the Nordic Models (NFoW), funded by the Nordic Council of Ministers.

    Abstract [en]

    This article discusses the rightful resistance in the form of public interest litigation (PIL) in China from three aspects, including broader public involvement with urbanites at the forefront, challenging the government and state-owned monopolies, and an alternative channel for rights claims and public participation. The paper argues that PIL is a rightful resistance under the authoritarian regime in which Chinese people are making use of the law and judicial system to fight against rights infringement and make their voices heard.

    The legal framework and national policies for urban greenery and green values in urban areas2020Report (Other academic)
    Abstract [en]

    In the light of compact city aspirations and commitments in the Nordic Region, it is appropriate that fresh light should also be shed on green values and their application in urban areas. Spatial planning plays a critical role here, determining the use of land. The legal framework, therefore, needs more attention, particularly when comparing different Nordic planning systems involved in developing, preserving and protecting green values in the urban environment. This study examines and compares the five Nordic countries’ planning legislation, and related environmental legislation when it is connected to developing, preserving and protecting green characteristics and qualities in urban areas. It also identifies and briefly describes, the most important national policy/guiding documents and national goals.

    Í skýrslu þessari er fjallað um áskoranir og tækifæri í löggjafarsamstarfi Norðurlanda en það er mikilvægur þáttur í samstarfi norrænu landanna samkvæmt samstarfssamningi þeirra (Helsingforssamningnum). Hér eru gerðar ýmsar tillögur að því hvernig unnt er að efla löggjafarsamstarfið.

    Færð eru rök fyrir því að eflt norrænt löggjafarsamstarf leiði til lagabóta í löndunum, sporni gegn og komi í veg fyrir stjórnsýsluhindranir á Norðurlöndum og veki athygli á norræna módelinu um allan heim. Öflugra löggjafarsamstarf hefur mikið að segja um hvort það stefnumið náist að Norðurlönd verði best samþætta svæði heims í samræmi við sameiginlega yfirlýsingu norrænu forsætisráðherranna frá árinu 2016.

    Inge Lorange Backer, höfundur skýrslunnar, er prófessor emeritus við Óslóarháskóla og hefur mikla reynslu af norrænu samstarfi á sviði laga og réttar. Hann var fulltrúi Noregs í norrænu embættismannanefndinni um löggjafarsamstarf þegar hann var skrifstofustjóri á lagaskrifstofu dómsmálaráðuneytisins í Noregi (1995–2008).

    Denne rapporten peker på utfordringer og muligheter for det nordiske lovsamarbeidet, som etter den nordiske samarbeidsavtalen (Helsingforsavtalen) er en sentral del i nordisk samarbeid. Rapporten har en rekke forslag til hvordan man kan styrke lovsamarbeidet.

    Rapporten fremhever at et styrket nordisk lovsamarbeid kan gi bedre lovgivning i hvert enkelt land, forebygge og motvirke grensehindre i Norden,og bidra til å fremheve den nordiske modellen i verdenssamfunnet. Et sterkere lovsamarbeid er viktig for å nå målet om at Norden skal være denmest integrerte region i verden i samsvar med de nordiske statsministrenes felles erklæring i 2016.

    Rapportforfatteren, professor emeritus Inge Lorange Backer ved Universitetet i Oslo, har lang erfaring fra nordisk samarbeid innenjustisområdet. Som ekspedisjonssjef i Lovavdelingen i Justisdepartementet i Norge (1995–2008) var han Norges medlem i den nordiske embetsmannskomiteen for lovsamarbeid.

    Current Polar law developments indicate that both the Arctic and the Antarctica will continue to be the focus of growing scientific, international, political, media and public discourse for the foreseeable future. The regulation of resources and associated issues form one of the key areas of Polar law and will thus continue to constitute the crux of legal, geopolitical, socio-economic, and environmental developments. An overview of Polar law questions and topical developments was provided in the pioneering 2010 Polar Law Textbook and in the 2013 Polar Law Textbook II both of which covered a number of topics relevant to the Polar resources debate. Building on this work, this new volume focuses on topical issues of law and resource development in the Polar Regions and covers topics of current and emergent resource-related issues mainly from a legal and political perspective.

    Abstract [en]

    In all Nordic countries, employers are required to prevent and respond appropriately to sexual harassment in the workplace. Nevertheless, the problem remains widespread, as has become increasingly clear in connection with the #MeToo campaign. In this review, we identify the laws that apply in the Nordic countries. The #MeToo campaign swept across a large number of countries in the autumn of 2017, enabling women to share their experiences of sexual harassment and joining forces to draw attention to the problem.

    Sexual harassment refers to a behaviourof sexual nature that violates the dignity of another person. Examples include comments about somebody’s breasts, a person sending sexually explicit pictures to a colleague without consent, somebody intentionally touching somebody else inappropriately and a supervisor asking a subordinate for sexual favours.The large number of testimonies that have surfaced since the launch of the #MeToo campaign show that these types of violations – which target mainly women – are commonplace in Nordic workplaces. The many reports of mistreatment also indicate that perpetrators are rarely held accountable for their behaviour, despite the fact that sexual harassment is illegal in all Nordic countries. Against this background, Nordic Information on Gender (NIKK) has taken a close look at what thelaws and legal protection in relation to sexual harassment in the workplace look like in the Nordic nations.

    Abstract [en]

    In 2003, the Nordic Council of Ministers issued the report “Access and Rights to Genetic Resources: A Nordic Approach”. Considering the international framework developed on access to genetic resources and benefit sharing from its use, the report and the ministerial follow-up, the Kalmar Declaration, provided a set of recommendations on how the Nordic countries and the Nordic Gene Bank should respond to this development regarding different types of genetic resources.  Since then, several new and relevant international developments have occurred. This has created a need for renewed awareness and new recommendations on the Nordic approach to access and rights to genetic resources by the Nordic countries and The Nordic Genetic Resource Center (NordGen). In this updated report, several new issues are addressed such as for example the digitalization of genetic information and new international agreements like the Nagoya Protocol and the implementation of the International Treaty on Plant Genetic Resources for Food and Agriculture.

    Abstract [en]

    During the past few years, reproductive technology and surrogacy have emerged in a number of European countries as issues of debate. There has been a steady increase in the use of reproductive technology in the Nordic countries, as well as an increase in the use of cross-border medical treatment in order to achieve pregnancy. At the same time, a number of ethical issues have been raised concerning the rights of the participants, including the children. In the fall of 2013, the Nordic Committee on Bioethics organised a conference in Reykjavik that focused on the current situation in the Nordic countries and on the global aspects of reproductive technology and surrogacy, including the market that is emerging in this field. This conference summary highlights the main ethical issues facing researchers, policymakers and practitioners who deal with these issues.

    Abstract [en]

    Secrecy, or the ability to keep ones identity hidden behind a corporate veil, is a key facilitator of fisheries crime, includingtax crime and other ancillary crimes in the fisheries sector. Secrecy means that investigators “don’t know what they don’t know” and is a fundamental challenge to fisheries crime law enforcement. The focus of this report is the jurisdictions that facilitate secrecy in fisheries, the flags of convenience, and particularly those that are contracted out to private companies, the so-called private flags, and the impact flags of convenience and secrecy has on effective fisheries crime law enforcement.

    The report is the result of the joint effort of the INTERPOL Fisheries Crime Working Group (FCWG) and the North Atlantic Fisheries Intelligence Group (NA-FIG), with the input and support of the Secretariats at INTERPOL and the United Nations Office on Drugs and Crime. It was made possible with the financial support of the Norwegian Agency for Development Cooperation (Norad) and the Nordic Council of Ministers.

    Abstract [en]

    Nordic co-operation on legislative affairs falls under the remit of the justice ministers. It is based on the principles contained in the Helsinki Treaty, the general principles for Nordic co-operation and this programme for co-operation. The strategic priorities for 2023-2024 include the rule of law, a unified legal system and Nordic synergies. In addition, particular attention will also be paid to the prevention of crime and terrorism, both of which are often cross-border in nature.

    Abstract [en]

    Co-operation within the justice sector is undertaken by the Nordic Justice Ministers. It is based on the principles of the Helsinki Treaty, the overarching principles and priorities of Nordic co-operation and the present co-operation programme. The Co-operation Programme for Justice Affairs in the 2025–2030 period prioritises the areas of Nordic legal cohesion, legal certainty in the Nordic Region and the prevention and combating of criminality. The co-operation also places special focus on the prevention of criminality and terrorism, which is often cross-border in nature.

    Abstract [en]

    Nordic programme for co-operation on legislative affairs

    Nordic co-operation, which involves Denmark, Finland, Iceland, Norway, Sweden, the Faroe Islands, Greenland and Åland, was formalised with the establishment of the Nordic Council in 1952.

    The Helsinki Treaty, signed a decade later in 1962, is the formal legal document that regulates Nordic co-operation. In 1971, the Nordic Council of Ministers was established in order to facilitate co-operation between the governments of Sweden, Denmark, Norway, Iceland, the Faroe Islands, Greenland and Åland. The Helsinki Treaty was most recently amended in 1995.

    Co-operation on legislative affairs is a tool used in the work to promote the common principles shared by the Nordic legal systems, which are based on shared Nordic values. The co-operation is also a tool used in the work on European law and for facilitating the implementation of EU/EEA acts and other international obligations.

    Nordisk samarbejdsprogram for justitssektoren

    Det nordiske samarbejde som omfatter Danmark, Finland, Island, Norge og Sverige samt Færøerne, Grønland og Åland blev formaliseret med oprettelsen af Nordisk Råd i 1952.

    10 år senere i 1962 underskrev landene Helsingforsaftalen som er det formelle retlige dokument der regulerer det nordiske samarbejde. I 1971 blev Nordisk Ministerråd oprettet for at varetage samarbejdet mellem de nordiske regeringer og den politiske ledelse på Færøerne, Grønland og Åland. Helsingforsaftalen blev senest justeret i 1995.

    Det retlige samarbejde er et værktøj i arbejdet med at fremme grundlæggende fælles principper i nordisk lovgivning i overensstemmelse med et nordisk værdifællesskab. Samarbejdet er også et værktøj i det europæiske lovgivningsarbejde og ved gennemførelse af EU/EØS retsakter og andre internationale forpligtelser.

    I denna bok redogörs för likheter och olikheter i de nordiska ländernas äktenskapsrätt. Här behandlas ingående och upplösning av äktenskap, underhållsskyldighet mellan makar och f.d. makar samt alla frågor som rör makars förmögenhetsförhållanden (äganderätt och giftorätt, ansvar för skulder, avtal mellan makar, bodelning, skevdelning och jämkning m.m.). Äktenskapsrätten är likartad i de nordiska länderna, men den gemensamma lagstiftningen från 1920-talet har glidit isär genom lagstiftning i respektive länder. Bärande teman är hur dessa olikheter kan orsaka problem när medborgare flyttar över en nordisk gräns samt om harmonisering är möjlig.

    På uppdrag av de nordiska justitieministrarna har en arbetsgrupp undersökt möjligheterna att harmonisera familje- och arvsrätten samt rättsförhållandet mellan barn och föräldrar i Norden. Undersökningen redovisar de viktigaste olikheterna i rättsreglernas utformning, tillämpning och syften. Den klargör vilka olikheter som kan vålla praktiska problem. Vidare beskriver den i vilka frågor det från praktiska utgångspunkter finns ett behov av ett nordiskt lagstiftningssamarbete. Slutligen skapar den en bild av vilka frågor som kan lämpa sig för nordiskt lagstiftningssamarbete på kort, medellång och lång sikt.

    Denna bok ingår i en serie om tre. De övriga två är Nordisk arverett (Nord 2003:3) och Nordisk børneret (Nord 2003:4).

    Oikeusalan pohjoismainen yhteistyöohjelma

    Virallinen pohjoismainen yhteistyö käynnistyi Pohjoismaiden neuvoston perustamisen myötä vuonna 1952. Yhteistyöhön osallistuvat Islanti, Norja, Ruotsi, Suomi ja Tanska sekä Ahvenanmaa, Färsaaret ja Grönlanti.

    Kymmenen vuotta myöhemmin, vuonna 1962, allekirjoitettiin Helsingin sopimus, joka on pohjoismaista yhteistyötä säätelevä virallinen oikeudellinen asiakirja. Vuonna 1971 perustettiin Pohjoismaiden ministerineuvosto Pohjoismaiden hallitusten ja Ahvenanmaan, Färsaarten sekä Grönlannin poliittisen johdon yhteistyöelimeksi. Helsingin sopimusta on muutettu viimeksi vuonna 1995.

    Oikeusyhteistyö on väline, jonka avulla Pohjoismaat voivat yhteisten arvojen pohjalta edistää yhteispohjoismaisia perusperiaatteita lainsäädäntötyössä. Yhteistyö on myös väline Euroopan tason lainsäädäntötyössä ja EU- ja Etasäädösten sekä muiden kansanvälisten velvoitteiden täytäntöönpanossa.

Yhteistyö perustuu Helsingin sopimuksen periaatteisiin, pohjoismaisen yhteistyön yleisperiaatteisiin ja priorisointeihin sekä kulloinkin voimassa olevaan yhteistyöohjelmaan. Pohjoismaiden oikeusministerien yhteistyössä vuosina 2025–2030 painotetaan ponnisteluja Pohjoismaiden lainsäädännön yhdenmukaisuuden, pohjoismaisen oikeusvarmuuden ja rikollisuuden ennaltaehkäisyn ja torjunnan puolesta. Yhteistyössä keskitytään myös erityisesti rikollisuuden ja terrorismin torjuntaan niiden rajat ylittävän luonteen vuoksi.

    Sweden is leading the work of the Nordic Council of Ministers in 2018. The Nordic countries have a tradition of cooperating, and our cooperation in the area of gender equality has been under way for over 40 years now. Our countries share many similar experiences, meaning that we can learn from each other. In support of this cooperation, we have the four-year cooperation programme ‘Together for gender equality’. For 2018, Sweden has chosen to prioritise issues concerning men and gender equality, efforts to prevent men’s violence against women, and gender mainstreaming; we will conduct several Nordic activities on these themes. The programme of activities for the 2018 Swedish Presidency also supports the efforts of the Nordic countries and the Nordic Council of Ministers to achieve the goals of the 2030 Agenda.

    Norræn samstarfsáætlun á löggjafarsviði

    Norrænt samstarf Danmerkur, Finnlands, Íslands, Noregs og Svíþjóðar auk Álandseyja, Færeyja og Grænlands hófst formlega með stofnun Norðurlandaráðs 1952.

    Tíu árum síðar árið 1962 undirrituðu löndin Helsingforssamninginn sem norrænt samstarf grundvallast á. Norræna ráðherranefndin (NMR) var stofnuð 1971 en hlutverk hennar er að halda utan um samstarf norrænu ríkisstjórnanna og yfirvalda á Álandseyjum, í Færeyjum og á Grænlandi. Helsingforssamningurinn var síðast endurskoðaður árið 1995.

    Löggjafarsamstarfið er tæki í starfi sem miðar að því að skapa sameiginlegar grundvallarreglur í löggjöf Norðurlandanna í samhljómi við almenn norræn gildi. Samstarfið er einnig tæki í evrópsku löggjafarsamstarfi og við innleiðingu ESB/EES-gerða og annarra alþjóðlegra skuldbindinga.

    Treaty of Co-operation between Denmark, Finland, Iceland, Norway and Sweden (the Helsinki Treaty). This Treaty was signed on 23 March 1962 and entered into force on 1 July 1962. The original text has been amended by Agreements that were signed on 13 February 1971, 11 March 1974, 15 June 1983, 6 May 1985, 21 August 1991, 18 March 1993, and 29 September 1995. The most recent amendments entered into force on 2 January 1996.

    Trafficking in Human Beings: Report from a conference on Identification of victims and criminals – why we do not notice them2014 (ed. 2014:526)Book (Other academic)
    Abstract [en]

    In the Nordic countries, most of the reported cases of trafficking in human beings today concern women and girls trafficked for sexual exploitation, but experiences from Europe indicate that human trafficking has increased also in farming, household work, construction, and house building, as well as in begging, shoplifting and thefts. The conference Identification of victims and criminals – why we do not notice them on 30–31 May 2013 in Tallinn, Estonia formed the conclusion of a Nordic-Baltic-Northwest Russian cooperation project. Around 80 participants attended the two-day conference to discuss ways of identifying victims and criminals and to find answer to the question of why we do not notice victims or criminals, even though we now have available to us facts, figures, research and knowledge about human trafficking as a part of international organized crime.
